Warranty
THE MAGAZINE warrants all of our products
to be free from defects in material and
workmanship for a period of 1 year from
the date of delivery.
We do not warrant against normal wear and
tear, or damage due to customer accident
or misuse. Natural variations in products
made in whole or in part of natural materials,
such as leather, wood, or stone, are not
considered defects.
Handmade products will generally vary in
color or texture. The appearance may vary
in natural, stained or dyed wood surfaces;
in painted wood or metal surfaces, particularly
those applied by hand such as *antique*
style finishes; and in furniture coverings
which are often from different dye lots.
Neither wood, leather, metal nor fabric
products are suitable for outdoor use,
unless expressly specified. Leather and
fabric are subject to natural wear and
may discolor, fade, tear, stain, stretch,
wrinkle or shrink. Wood and metal may
stain, scratch, chip or fade or darken.
The customer must exercise proper care to
minimize any such damage.
Imported European lighting fixtures are
not U.L. rated unless noted in the
Product Specifications. It is the responsibility
of the customer to modify the lighting
fixtures upon installation if necessary
to meet local electrical codes.
Warranty claims must be presented to us
in writing, so that we may arrange for
an inspection. Our responsibility is limited
to reasonable repair of the product, or
to replacement if the product cannot reasonably
be repaired.
TO THE EXTENT ALLOWED BY LAW, ANY IMPLIED
WARRANTIES -- INCLUDING ANY WARRANTY OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE -- ARE LIMITED IN DURATION TO
THE DURATION OF THESE WRITTEN WARRANTIES.
WE SHALL NOT BE LIABLE FOR LOSS OF TIME,
INCONVENIENCE, COMMERCIAL LOSS, OR INCIDENTAL
OR CONSEQUENTIAL DAMAGES.
Custom Order Policy: No Changes, No
Cancellations, No Returns and No Refunds
Please make your choice about a custom order
very carefully and cautiously, as it is
impossible for THE MAGAZINE to store and
re-sell rejected custom items to other
customers. Hence, our policy is
that CUSTOM ORDERS CAN NOT BE CHANGED
OR CANCELLED IN WHOLE OR IN PART ONCE
AUTHORIZED. There is NO REFUND on
a custom order once it is ordered from
the manufacturer. A
“Custom Order” is defined as any merchandise
that must be ordered through either a
domestic or international manufacturer.
A custom order is “authorized” as soon
as a customer places a deposit on their
order.
Policy on Purchase Orders for In-Stock Merchandise:
No Changes, No Cancellations, and 25%
Refund Charge
Please make your purchase choice very carefully.
Any purchase for in-stock merchandise
from THE MAGAZINE is considered a typical
“Purchase Order.” Most purchase
orders for in-stock merchandise will be
shipped to the customer quickly, therefore,
Purchase orders can not be changed in
whole or in part, or cancelled.
Only purchase orders for UNSHIPPED in-stock
merchandise can be cancelled with pre-approval.
In the unlikely case that a cancellation
of an unshipped purchase order is approved
by THE MAGAZINE all cancellations are
subject to a 25% charge on item(s) gross purchase price. This
charge will be deducted from the Purchaser’s
remaining amount due.
Only STORE CREDIT will be issued for returned
in-stock merchandise that has already
been shipped.
In the rare case that THE MAGAZINE
agrees to accept a return on a product
already shipped, because of extraordinary
circumstances, it will only issue a STORE
CREDIT for the full purchase price and
shipping cost after the merchandise has
been returned and is in perfect condition.
Payment and Tax
All orders must be paid in full prior to
shipping.
If you pay by personal check, shipment cannot
be made until your check has cleared,
which generally will take five business
days from receipt.
Payment by cashier¹s check or wire transfer
requires no waiting period, and shipment
will be made as soon as possible.
No sales tax is charged on your order unless
the order is delivered in the State of
California or the Buyer is a California resident.
In Home Delivery:
Shipping and Handling charges will be quoted
at the time of your purchase. These shipping
charges do not include delivery into your
home and are for the Continental USA only!
We offer "White Glove" delivery, where the
product is delivered into your home, unpacked
and assembled (if necessary), placed where
you prefer, and any packaging material
is removed. There is an additional charge
for this service.
The products are well packaged and transit
damage is rare. Nevertheless, it can occur,
and if it does you will be able to discover
it when the goods are unpacked and examined
AT THE TIME OF THE DELIVERY.
INSPECT all items in the presence of the
delivery person/people.
If the goods are not in the expected condition,
you may reject the delivery or have delivery
driver CLEARLY mark on the delivery receipt
ALL damages.
UPS / Other Delivery
- Inspect item for obvious damage IMMEDIATELY
upon delivery, IN THE PRESENCE of the
Delivery Person.
- All obvious damage must be noted on
the Bill of Lading before the Delivery
Person departs.
- A damage claim must be filed with the
Delivery Company within 3 business days
of receipt of the item.
- A copy of this claim must be sent to
THE MAGAZINE.
- If concealed damage is discovered upon
unpacking the item, a damage claim must
be filed with the Delivery Company within
3 Business days of receipt of the item.
- Once a damage claim has been initiated
with the delivery company, a pick up authorization
must be filled out and faxed to THE MAGAZINE
at (510) 549-3005.
- If no damage claim is filed with the
delivery company, or if a damage claim
is filed after 3 business days, THE MAGAZINE
will not issue a pick up authorization
for this item.
THE MAGAZINE is Not Responsible for Delays
in Shipping
Due to new homeland security laws, shipping
on some orders may be delayed due to increased
inspection requirements. Also, manufacturers
may have shipping delays due to increases
in orders, work stoppages, equipment failure,
etc. THE MAGAZINE is not responsible
for shipping delays on any product order.
Return of Damaged Goods
THE MAGAZINE will repair or replace any
damaged goods. Replacement goods will
be sent with no additional shipping charges,
as soon as the original order is returned
to us and the replacement has arrived
in our warehouse.
If goods need to be returned, customers
must contact THE MAGAZINE and receive
a “Return Authorization Number,” any box
must be clearly marked with that number
or the returned goods will be refused!
Dispute Resolution Policy – California Choice of Law and Venue
The MAGAZINE’s office and sales site is
located in Berkeley, California. THE MAGAZINE is incorporated in
the State of California. Products are ordered and in-stock
orders are shipped from Berkeley, California. By purchasing merchandise from THE
MAGAZINE the customer agrees that California law will apply to any dispute or claim,
and any legal claim for damages and/or
injunctive relief must be filed in Alameda County, California.
Customer Pre-Authorizes Full Payment Prior
to Merchandise Shipment and Accepts Title
of Goods
A deposit will
be collected for all orders. If
a customer utilizes a credit card for
a deposit, then the customer authorizes
THE MAGAZINE to charge the remaining amount
due when the merchandise is prepared and
ready for immediate shipment to the customer.
Merchandise will not be shipped to the
customer unless and until all orders are
paid in full. Once payment is made
in full, a customer is the holder of the
title of goods.
